GENERAL

  • My art and design is for personal use only, unless stated otherwise upon commissioning me. 
  • Do not use my art for AI learning or NFT. Both usage is strictly forbidden.
  • You may use my art as reference for practice but do not trace or heavily reference it for your own commission or zine work. 
  • Please don’t edit my art in any way shape or form.
  • By commissioning me, you are purchasing my service as an artist only.
  • I reserve the right to post your finished artwork in my gallery for any reason.
  • I reserve the right to decline any project or client for any reason.
  • I reserve the right to refund you the full amount paid if I no longer wish to work on your project for any reason.
  • Clients who have commissioned and/or received work before this TOS has gone into effect are still bound to its contents.
  • These clients are permitted to include signatures and/or watermarks indicating the artwork is my intellectual property. Credit is mandatory.

PAYMENT 

  • I will only start working on your commission once I have received the full payment unless we have agreed on a payment plan.
  • I will decline your commission after 3 days if no payments are made. If there are any issues please don’t hesitate to inform me so i can put the commission on hold. 
  • Failure of paying for the proposal in time will result in the commission being automatically cancelled, or an additional 20% fee for late payment if the client wishes to extend.
  • In the case of an extension payment, I allow up to an additional week. If the client fails to pay by the extension, the commission will be automatically declined. If this happens, you are at risk of being blacklisted.
  • In the case of large orders (200$+), milestone payment can be applied if the client so requests.

REFUNDS & CHARGEBACKS

  • I can only refund 100% of the payment if I have not started working on the sketch, which only applies if payment is upfront.
  • There will absolutely be no refunds once the sketch has been confirmed and I have been sent payment.
  • If I can't finish the commission in time after sketch, I will refund 50%, including the lost fees during currency exchange.
  • You are NOT authorized to issue a chargeback for any reason.
  • If for any reason your account malfunctions or authorizes a refund request without your knowledge, you must contact me as soon as possible in order to resolve the issue.
  • You are required to contact me when you need to cancel a commission request.
  • Purposefully issuing a chargeback without contacting me to cancel / refund a project will result in immediate blacklisting for you as well as your email address, and anyone sharing your account, including side accounts.

DEADLINES AND DELIVERY

  • My turnaround time is 3 days up to a month depending on the complexity of the commission. I will let you know the estimate waiting time upon approval of commission request. 
  • During commission, client is free to ask as many updates as you want, and in case I need longer time to complete the commission I will let you know. 
  • The finished commission will be delivered via V-Gen/ E-mail.

REVISIONS

  • No wips and revisions can be made for SKEB/surprise me commission. I will not be responsibe should you feel dissatisfied with the commission upon receiving the final file. To avoid this, please provide as much detail in the request form.
  • For regular commissions, I allow up to 2 revisions per illustration: during sketch phase for major revisions and before final delivery (minor revisions only). Any more than that I will charge extra fee. To avoid this, please be as clear as possible in your request

INTELLECTUAL PROPERTY RIGHTS

  • As the artist I can: use the commissioned work as sample of my art, upload to social media a lower resolution version of the commissioned work, use the commissioned work for my art portfolio
  • As the artist I can not: print your commission and sell it on merchandise, claim your characters as mine (I’ll always tag you on the commission post to make sure proper credits are given)
  • As the commissioner you can: upload the artwork to your social media giving credits to me for the artwork, ask me not to upload the artwork to social media until a certain date, use it as profile picture, pagedoll for websites and overall non-monetized decoration, print it for personal use only, such as in body pillows, etc… In case you paid for commercial use you may use the work according to what we agreed
  • As the commissioner you can not: claim the artwork as yours, use the artwork for profit without my consent, remove or cover my watermark/signature when posting on social media

COMMERCIAL USE FEE

  • If you desire to use your commission to earn money additional fees will apply, make sure to state what do you want your commission for from the start
  • Commercial use means that you will be directly monetizing and reproducing the art I made (in order to sell on merchandise, use my art as assets for a commercial video videogame, etc). If you won't be earning money directly from the art I made your price would remain unaltered (stream schedule poster, profile pictures, social media banner art)
  • for any commission you plan on monetizing a 100% fee for assets/illustrations or 200% fee for custom character design will be added 
  • If you have any doubt regarding if you commission counts as commercial or not hesitate to message me via Vgen.

COMMUNICATION

  • All communications must be held via VGen Messages, Email, Discord, Instagram or Twitter, with VGen Messages and Discord being the priority. In the case of Twitter/Insta, please make sure your DMs are open, and that you must check your DMs often as both apps can be a hassle to deal with.
  • I do not accept any other social media platforms, as I am not obligated to create an entirely new account to contact you.
  • Communications can be made in either English, Japanese or Indonesian, with English being the preferred language.
  • If you have difficulties speaking either language, please use a translator for inquiries.
